Terms of Service

Please read these terms carefully before commissioning an artwork, requesting a video edit, or purchasing from the shop.

📋 1. General Commission Policies

By submitting an inquiry and paying the initial downpayment, you formally agree to all the terms outlined on this page.

Right to Decline: I reserve the right to respectfully decline any request that falls outside my current skills, capabilities, or comfort zone (e.g., inappropriate content, offensive material, or overly complex requests without adequate references).
Reference Photos: For portrait commissions, the client must provide a clear, high-resolution, unedited reference photo. The final output heavily depends on the quality of the reference provided.
Communication: All commission details must be finalized before payment is made. Constant changes to the core idea after work has begun will incur additional fees.

To ensure a fair exchange of time and effort, the following payment structures are strictly enforced:

50% Downpayment: A non-refundable 50% downpayment is required before any sketching or editing begins. This secures your slot and covers initial time and materials.
Final Payment: The remaining 50% balance must be paid in full upon completion, before the final physical artwork is shipped or the final high-resolution video file is turned over.
Cancellations by Client: If you cancel the commission after work has started, the 50% downpayment is forfeited to compensate for the labor already rendered.
Refund Exceptions: A full refund of the downpayment will only be issued under the following conditions:
- If you cancel the commission before any sketching, editing, or material preparation has begun.
- If I (the artist) am forced to cancel your commission due to unforeseen personal emergencies, illness, or inability to complete the project.
Accepted Methods: Payments are accepted strictly via GCash, Maya, or Maribank.

I believe in transparency. I will send you Work-In-Progress (WIP) updates so we remain on the same page.

Free Revisions: Clients are entitled to two (2) minor revisions during the WIP stages (e.g., slight adjustments to shading, minor facial structure tweaks, or video color grading adjustments).
Major Changes: Any major changes requested late in the process (e.g., asking to change the reference photo entirely, changing the art medium, or completely restructuring a video edit) will require an additional fee or may be declined.

All physical artworks are packed securely with rigid backing and protective sleeves to prevent bending or water damage.

Shipping Fees: The client shoulders all shipping and handling fees.
Couriers: For Metro Manila and nearby areas, Grab or Lalamove is preferred. For Provincial deliveries, LBC Express will be used.
Liability: Once the package is handed over to the courier, I am no longer liable for delays, loss, or mishandling by the courier service. However, I will assist in tracking the package to the best of my ability.
Digital Copies: High-resolution digital scans of traditional art and digital video files are delivered via Google Drive at no extra cost.

Understanding who owns what is crucial for both the artist and the client.

The Golden Rule: You own the physical piece of art. I own the copyright to the image.

Artist's Rights: I (TOPEH) retain full copyright to all created artworks and edits. I reserve the right to post the process, timelapse videos, and final images on my portfolio, social media, and marketing materials.
Privacy Requests: If the commission is a surprise gift, please notify me in advance! I will delay posting the artwork publicly until after the gift has been received.
Personal Use Only: Commissions are strictly for personal use. You may not mass-produce, sell, or use the artwork/video for commercial profit (e.g., printing on merchandise to sell) unless a separate Commercial License is purchased.

Policies applying specifically to items bought directly from the Merchandise Shop:

Order Verification: All shop orders paid via the QR Checkout flow are subject to manual verification. If your reference number is invalid or the amount is incorrect, the order will be canceled.
All Sales Final: Due to the nature of custom and limited-stock merchandise, all shop sales are final once shipped. Returns or exchanges are not accepted unless the wrong item was sent.

I highly value word-of-mouth recommendations! The Referral Reward system is subject to the following rules:

Eligibility: The referred client must explicitly state the referrer's name in the "Who referred you?" section of the initial inquiry form. Referrals claimed after the project has already started will not be honored.
Successful Commissions Only: A referral is only considered "successful" once the referred client has paid the 100% total balance and the project has been fully delivered.
The 6% Cash Back: The 6% cash back is calculated based on the base price of the commission (excluding framing and shipping fees).
Payout Timing: Cash back rewards will be disbursed via GCash directly to the referrer within 3-5 business days after the referred project is successfully completed and fully paid.
